Acceptance of Terms

The Site is owned and operated by The Sum of Us Restaurant and Cafe LLC (“we” or “us”) operating as Encounter Coffee Roasters. The Sum of Us is a limited liability company registered in the UAE with its registered office address Ground Floor. Burj al Salam, Trade Centre, 6th Street, Sheikh Zayed Road, Dubai, UAE, PO Box 122500.

Welcome to Encounter Coffee Roasters e-commerce website (“Website”).  ECC provides services to you subject to the following Terms of Use (“Terms”) that might be amended from time to time with no notice to you. You are encouraged to review these Terms each time you use the Website.

Your continued use of the Website constitutes an affirmation and acknowledgement that you have read, understood and agreed to be bound by these Terms and any further amendments.

We reserve the right, in our sole discretion and without notice to you, to revise the products and services available on the Website and to change, suspend or discontinue any aspect of the Website and we will not be liable to you or to any third party for doing so. We may also impose rules for and limits on use of the Website or restrict your access to part, or all, of the Website without notice or penalty. Your continued use of the Site will constitute your acceptance of any such changes.

If you do not accept these terms please refrain from using our website and exit immediately.

 

Accuracy of Information

All material on the Website is provided in good faith. It is derived from sources believed to be accurate and current as at the date of publication. Your use of the website is at your sole risk.

 

Intellectual Property Rights

ECC’ website and all of its content, including, but not limited to, its software or HTML code, scripts, text, artwork, photographs, images, video, and audio are the intellectual property of ECC. All content provided by ECC is copy write protected.

You may not copy, reproduce, publish, transmit, distribute, perform, display, post, modify, create derivative works from, sell, license or otherwise exploit this site or any of its content without our prior written permission. You may not use this website, or any of its content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own website. Any unauthorized copying, alteration, distribution, transmission, performance, display, or other use of these materials is prohibited.

 

Your account

As an ENCOUNTER COFFEE ROASTERS Coffee Roasters WEBSITE account holder you agree that you are personally responsible for the activity and your communication within your account. You are also responsible for the safety of your login password and access from your computer, restricting unauthorized access. If you have any reason to believe that your account is being misused, please inform us immediately.

 

Currency

All prices are displayed in United Arab Emirates Dirhams. ECC is based in the United Arab Emirates where Taxes, GSTs and VATs are not chargeable and therefore not included in our pricing.

If you are a customer whose credit card is not denominated in the above currency you may still be able to check out in your credit card’s currency. ECC processes all payments through Network International Payment Solutions which accepts various worldwide currencies including: United Arab Emirates Dirhams, US Dollars, Argentina Peso, Australian Dollars, Brazilian Real, Canadian Dollars, Danish Kroner, Euro, GBP-Sterling, Hong Kong Dollars, Indian Rupee, Japanese Yen, Mexican Peso, New Zealand Dollars, Norwegian Kroner, South African Rand, Swedish Kroner and Swiss Francs.

 

Payment

When you select ‘Place Order” you will be directed to Network International Payment Solutions secure payment processing page. Your purchase can be converted to any currency supported by Network International Payment Solutions. If your preferred currency is not supported on Network International Payment Solutions there will be a currency conversion fee charged to your credit card. The final price will be calculated in accordance with the applicable exchange rate on the day your credit card company processes the transaction. SCT is not responsible for any fees and charges you may incur from your bank.

We also accept orders via email. Simply drop us a line hello@encountercoffeeroasters.com to let us know what you want, and your method of payment. We will contact you within 24 hours to discuss your order.

Unfortunately, we are unable to accept payment via cheque, bank transfer or any method other than those listed above.

All payments will be processed in United Arab Emirates Dirhams.

If you are paying by Cash on Delivery we ask you to please have the exact money ready to avoid our delivery staff having to carry lots of change, and be sure to be available to receive the order at the specified address at the time communicated by the courier company. Cash payments must always be made in AED currency.

 

Dispatch and Delivery

ECC pledges to accept orders placed via the Internet, within the limit of available stocks, on the terms of this instrument, which you must declare you have read and accepted when you validate your order.

The products will be dispatched in maximum 48 business hours from the confirmation of order. If the order is not dispatched in five business days for any reason, you will be contacted via email to offer an alternative product, partial shipment or full refund.

Estimated delivery times are to be used as a guide only and commence from the date of dispatch, ECC is not responsible for any delays caused by destination customs clearance processes.

 

Import Taxes and Duties

As the recipient, you are liable for all import duties, customs and local sales taxes levied by the country you are shipping to; payment of these maybe necessary to release your order from customs on arrival. SCT will not be held liable for any fees or taxes you may incur or if your product is seized by customs. We advise that you are familiar with your package destination’s import duty, customs and local sales taxes as well as its rules and regulations for importing foreign goods and products.

 

Limitation of Liability

  1. The photographs and texts illustrating and describing the products on the Media are non-contractual and for information purposes alone. ECC shall not be liable in case of errors or omissions in the photographs or texts displayed on the Media.
  2. For international deliveries to countries other than those where ECC guarantees delivery, ECC shall not be liable if the products do not comply with the existing laws and regulations of the country of delivery.
  3. Without limiting the scope of these General Conditions of Sale, no claim of any kind, whether as to products delivered or non-delivery of products, or otherwise, shall be greater in amount than the purchase price of the products in respect of which damages are claimed. IN NO EVENT SHALL ECC BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY NATURE (EVEN IF THE ADVENT OF SUCH DAMAGE WAS KNOWN OR COULD HAVE BEEN KNOWN BY ECC), CAPABLE OF ARISING IN CONNECTION WITH ITS PRODUCTS, THEIR USE, SALE OR THE MEDIA.

 

Force Majeure

ECC will make every reasonable effort to fulfill its obligations. However, ECC cannot be held responsible for delays or failure to deliver caused by circumstances beyond its reasonable control. Such circumstances include strikes, wars, natural catastrophes or any others that make impracticable the production, transportation or delivery of products.

In the event of delay, ECC will perform its obligations as soon as reasonably possible, and it reserves the right to allocate any remaining product supply among customers in a fair and reasonable manner.

 

Cancellation and Return

ECC guarantees that all products will leave our Roastery at their peak condition.

In the event that your received goods do not match the ones you ordered or you are unsatisfied with the products, you must write us an email within seven days from the receipt and we will replace with the ones ordered (subject to availability) or refund you using the same method you used.

All returned goods must be in their original packaging, intact with their original documents. We will arrange refund within maximum 30 days after the receipt of the goods in our Roastery. We regret that gift-wrapping and shipping/courier costs cannot be refunded.

 

Applicable Law & Jurisdiction

These Terms and Conditions shall be interpreted and governed by the laws in force in Dubai, United Arab Emirates. Each party hereby agrees to submit to the jurisdiction of the courts of Dubai and to waive any objections based upon venue.
